The U.S. Supreme Court declined to review CareDx’s appeal in its false-advertising dispute with Natera Inc. (NASDAQ:NTRA), affirming lower-court rulings that rejected a $45 million damages award. The case centered on allegations that Natera misled customers by comparing its Prospera test with CareDx’s AlloSure test for kidney transplants.

A U.S. District Court judge overturned the jury’s $45 million award in 2023, finding no evidence that Natera’s statements deceived customers, though false advertising was confirmed. The 3rd U.S. Circuit Court of Appeals later upheld the ruling, rejecting CareDx’s argument that deception should be presumed in cases of deliberate falsehood.

Natera stated it was “pleased with the outcome,” while CareDx maintained its position that courts should presume deception in such cases. The Supreme Court offered no explanation for its decision.
