A US federal judge ruled Abbott Laboratories must face a proposed class-action lawsuit over claims its PediaSure Grow & Gain drinks were marketed as “clinically proven” to help children grow. Judge Paul Engelmayer said labeling and ads could mislead consumers into believing the product boosts height, not just weight or general development.
The lawsuit alleges Abbott’s use of a giraffe and ruler-like imagery, along with ads showing children comparing heights, reinforced misleading claims. Abbott maintains its labeling is “appropriate” and supported by evidence, arguing PediaSure aids overall growth and development.
Plaintiffs argue a child remained short but gained excess weight after daily use. The case will now proceed to trial, with potential implications for Abbott’s nutritional products segment.
