A US Appeals Court has temporarily paused a trade court ruling that blocked President Trump’s 10% across-the-board tariffs on imports. The tariffs, imposed under Section 122 of the Trade Act of 1974, were set to expire on July 24, 2026, and aimed to address balance-of-payments deficits.
On May 7, 2026, the US Court of International Trade ruled the tariffs unlawful, citing the absence of a “large and persistent” balance-of-payments deficit. The injunction was limited to two private importers and the State of Washington, leaving most tariffs in place.
The Appeals Court’s decision allows the tariffs to remain in effect while legal challenges proceed, pending further review.
