Tata Consultancy Services fails to overturn a $168 million damages award for alleged theft of DXC Technology’s proprietary software.

The U.S. Supreme Court declined to review Tata Consultancy Services’ challenge to a $168 million damages award for trade secret misappropriation. The award includes $56 million in compensatory damages and $112 million in punitive damages to DXC Technology, upheld by lower courts after a 2023 jury verdict initially proposed $210 million.

DXC, formerly Computer Sciences Corp, accused Tata of hiring 2,200 Transamerica employees to access and replicate its life-insurance software platform. Tata denied wrongdoing, arguing the information was not secret and its access was legal. A federal judge reduced the jury’s advisory verdict in 2024, with the 5th U.S. Circuit Court of Appeals affirming the decision in 2025.
