Bank of America agreed to a $2.25 million settlement to end a class-action lawsuit over allegations it charged customers duplicate out-of-network fees for balance inquiries at ATMs inside 7-Eleven stores. The complaint, filed in a California federal court, claimed the bank violated contractual obligations by billing two separate fees for a single transaction between May 1, 2018, and November 16, 2021.
The lawsuit targeted ATMs operated by FCTI, Inc. at 7-Eleven locations. Bank of America cited the desire to avoid litigation costs and risks as its reason for settling. Customers who previously received compensation under an earlier settlement in Weiss v. FCTI, Inc. are ineligible for this payout.
Eligible claimants must have held a Bank of America checking account and incurred multiple out-of-network fees during a single ATM visit within the specified period. The final per-person payout will depend on the number of approved claims after legal fees and administrative costs are deducted.
