A retired farmer received a $75,000 option payment from a data center developer to keep his land available for potential sale. Social Security did not count the payment as earned income under its retirement earnings test, as it compensates for restricting a sale rather than labor.

The exclusion means the payment avoids immediate benefit withholding but may still raise taxable Social Security benefits to 85% and trigger higher Medicare premiums under IRMAA rules two years later. Payments tied to consulting or crop-loss fees, however, would count as earned income.

The arrangement allows the developer to secure future purchase rights without an immediate transaction, while the farmer retains land use but cannot sell to others.
