Lawsuit alleges Kalshi violated trademark and data licensing terms to settle flight cancellation prediction markets without permission.
Flight-tracking firm FlightAware filed a federal lawsuit against prediction market platform Kalshi, accusing it of using proprietary flight data and trademarks without authorization. The complaint, filed in New York, seeks damages and an injunction to halt further use of FlightAware’s assets for settling bets on airline cancellations.
Kalshi launched flight cancellation markets on July 14, the same day it submitted a regulatory filing to the Commodity Futures Trading Commission. FlightAware claims Kalshi ignored a cease-and-desist letter and continued referencing its data despite adding a disclaimer that the markets were not endorsed by the company.
The lawsuit adds to Kalshi’s legal challenges, including separate actions from New York, Wisconsin, and Nevada over alleged unlicensed gambling. The case could set a precedent for prediction markets’ use of third-party data and branding without commercial agreements.
