The ruling hinges on the jury’s determination that the driver was a ‘borrowed employee’ under C.H. Robinson’s control, exposing the broker to vicarious liability. Lupus Superior, the motor carrier, held a satisfactory safety rating from the FMCSA at the time of the crash.
C.H. Robinson plans to appeal the decision, which follows recent court rulings reshaping liability standards in the trucking and logistics industry.
